WHAT DO YOU NEED?

Custody Motions will be heard in Courtroom#2, Monday through Thursday at 8:45am. No custody motions will be accepted on Fridays.

ACTION	FORM	COMMENTS
To file for custody	Complaint	This is the first form you file to start a custody action; this packet includes rules and notice on service. There is a $112 filing fee.
To Waive the $112 Filing Fee	In Forma Pauperis	Your income MUST be below the federal poverty level and you MUST have some proof of income.
To Change an existing custody order	Modification	MUST GIVE THE OTHER PARTY AT LEAST 3 DAYS NOTICE BEFORE TAKING THIS TO COURT.
The other party is not following the court order	Contempt	MUST GIVE THE OTHER PARTY AT LEAST 3 DAYS NOTICE BEFORE TAKING THIS TO COURT.
Immediate temporary custody due to threat of physical harm or that the other parent will take the child out of Beaver County	Emergency Relief	If there is no existing Court Order, you must file a complaint at the same time. If there is an existing order, you must file a Modification form at the same time. MUST GIVE THE OTHER PARTY AT LEAST 24 HOURS NOTICE BEFORE TAKING THIS TO COURT & BRING THEIR PHONE NUMBER.
Any situation not covered by any other forms	Special Relief	If there is no existing Court Order, you must file a complaint at the same time. MUST GIVE THE OTHER PARTY AT LEAST 3 DAYS NOTICE BEFORE TAKING THIS TO COURT.
To appeal the decision from the hearing with Juvenile Services	Exceptions	Be aware that this is “going to trial” and you really should hire an attorney.
To stop a custody action or a specific motion	Withdraw	This cancels the custody action or a previously filed motion.
To postpone a hearing	Continuance	YOU MUST GIVE THE OTHER PARTY AT LEAST 3 DAYS NOTICE BEFORE TAKING THIS TO COURT.
For the parent who has shared or primary custody and wants to move out of Beaver County	Relocation	YOU MUST GIVE THE OTHER PARTY AT LEAST 3 BUSINESS DAYS NOTICE BEFORE TAKING THIS TO COURT.
To stop the other parent from moving out of Beaver County	Answer to Relocation
Notice to the other party or their lawyer saying you are going to present a motion	Intention to Present	YOU MUST GIVE THE OTHER PARTY AT LEAST 3 DAYS NOTICE BEFORE TAKING MOTIONS OR PETITIONS TO COURT. MUST BE DONE FOR ALL MOTIONS EXCEPT EXCEPTIONS & TRUE EMERGENCIES.
